The Consumer Product Safety Commission ("CPSC") has a mandate to ensure the safety of consumer goods offered for sale in the United States.

The U.S. Consumer Product Safety Commission is charged with protecting the public from unreasonable risks of serious injury or death from thousands of types of consumer products under the agency's jurisdiction.  The CPSC is committed to protecting consumers and families form products that pose a fire, electrical, chemical, or mechanical hazard or can injure children.  The CPSC's work to ensure the safety of consumer products - such as toys, cribs, power tools, cigarette lighters, and household chemicals - contributed significantly to the 30 percent decline in the rate of deaths and injuries associated with consumer products over the past 30 years.

On occasion, imported products become subject to recall by the CPSC.  Recalls may be issued due to defective merchandise, or because the CPSC has determined that a product may be otherwise potentially harmful to consumers.  Simon Gluck & Kane LLP has counseled clients involved in product recalls, overseeing the recalls and submitting reports to the CPSC.

Simon Gluck  & Kane LLP has also been instrumental in securing agency approval of independent test results as satisfactory proof of compliance with safety and health requirements for imported merchandise.

In addition, recent passage of the Consumer Product Safety Improvement Act ("CPSIA") has expanded CPSC's jurisdiction exponentially, and has placed upon importers and domestic manufacturers (among others) numerous new and complex requirements.  Simon Gluck & Kane LLP has been called upon to counsel its clients on the frequent changes announced by the CPSC regarding the implementation of the CPSIA, in determining whether products are subject to the CPSIA, adn whether specific testing is required under the CPSIA.  Simon Gluck & Kane LLP has created its own Certificate of Compliance, based on the requirements of the CPSIA, that has helped the firm's clients comply with new certification required under the CPSIA.
