BARBARA Y. WIERBICKI

Barbara Wierbicki, a graduate of Pace University School of Law, is Of Counsel to Simon Gluck & Kane LLP.

Ms. Wierbicki has been involved in various aspects of the intricacies of trade as a hands-on manager effectively engaged in importing, exporting and manufacturing, prior to her work as a prominent Customs & International Trade attorney. For more than twenty years as legal counsel, she has assisted clients with issues in importing, exporting and international trade & compliance matters.

She has served as Customs Counsel to numerous importers. For many years she has been Customs and General Counsel to the Fashion Accessories Shippers Association/Gemini Shippers Association.

In her representation before Customs and Boarder Protection, Ms. Wierbicki has obtained CBP advance rulings; appealed and secured ruling modifications; and successfully defended detentions; seizures and penalty assessments; as well as achieving the successful mitigation of liquidated damages claims. This representation has also included the enforcement of Intellectual Property rights of clients as well as defending clients who have been accused of Trademark and Copyright infringement.

Ms. Wierbicki has also assisted importer’s targeted for CBP audits and has performed internal compliance self assessments to establish reasonable care compliance.

Ms. Wierbicki has also represented clients before the Food and Drug Administration, Fish and Wildlife, Consumer Product Safety Commission, International Trade Administration, the Commerce Department (dealing with Antidumping Duty and Countervailing Duty cases), and National Highway Traffic Safety Administration.

She has participated in the defense of clients before the Court of International Trade.

Ms. Wierbicki has authored and co-authorized articles for several Trade publications on various Customs and International Trade topics and has appeared on Panels for Trade Associations specifically addressing concerns of the Fashion Accessory Industry.

Her association memberships include the American Bar Association, the New York State Bar Association and the Customs and International Trade Bar Association; she has sat on the Board of Directors as General Counsel for the New York Chapter of Women in International Trade “WIT”), as well as the National Association of Exporting Companies (“NEXCO”).


Ms. Wierbicki is a member of the New York and Connecticut Bars and is admitted to practice before the U.S. District Court for the Southern District of New York, the U.S. Court of International Trade, the Court of Appeals for the Federal Circuit and the United States Supreme Court.
